In fact, there have been over 100 lawsuits filed since 2004 challenging prescreen offers of credit issued by mortgage and automotive lenders.

MarketerNet continually works with our FCRA and Privacy Compliance attorney, Oscar Marquis, former counsel for TransUnion, on improving our compliance program and monitoring the lawsuits taking place. We have worked with the bureaus to develop specific processes for maintaining compliance with FCRA regulations.

MarketerNet monitors compliance with regulations and consumer privacy laws by taking the following actions:

Maintaining a secure data environment for data storage, collection and usage.
Training our staff to be proficient in recognizing compliance issues. MarketerNet’s staff reviews all of our clients’ mail pieces and telemarketing scripts to ensure that they meet all FCRA and consumer privacy requirements. The bureau reviews each marketing piece as well to verify compliance.
Consulting with our lawyer, Oscar Marquis, former counsel for TransUnion, in order to proactively stay ahead of changing compliance in the direct marketing industry.
Scrubbing each list against the most current Do Not Call list and making sure that all of our clients who telemarket have a SAN number, provided by the Do Not Call registry.
Working with Experian and TransUnion to conduct extensive annual audits of our facilities and procedures.
Reviewing the Consumer Financial Services Law Report to stay up to date on current legal proceedings in the direct marketing industry.
